These Terms of Service (“Terms”) govern your use of hosting services provided by Capital Web Design (“we”, “us”, “our”).
By using our services, you agree to these Terms.
1. Services Provided
We provide managed WordPress hosting, including:
- Website hosting infrastructure
- WordPress core, plugin, and theme updates
- Troubleshooting and support
2. Accounts
You must:
- Provide accurate information
- Maintain the confidentiality of your login credentials
- Be responsible for all activity under your account
3. Acceptable Use Policy (AUP)
You may NOT use our services to host or distribute:
- Pornographic or sexually explicit material
- Violent or extremist content
- Content that infringes on copyright or intellectual property rights
- Illegal content under Canadian law
- Malicious software or phishing systems
We reserve the right to determine violations at our sole discretion.
4. Enforcement
We enforce violations strictly. We may, without notice:
- Suspend or terminate your account
- Remove content
- Report unlawful activity to authorities
No refunds will be provided in cases of policy violations.
5. Payments & Billing
- All services are billed in advance
- Subscriptions renew automatically (monthly or yearly)
- Payment method: credit card
Refund Policy:
- Monthly plans: No refunds
- Yearly plans: Prorated refunds may be issued at our discretion
6. Service Level Agreement (SLA)
We aim to provide 99.5% uptime, which allows for approximately:
- 3.6 hours of downtime per 30-day month
This uptime guarantee excludes:
- Scheduled maintenance
- Third-party outages
- Force majeure events
No financial compensation is guaranteed for SLA breaches.
7. Backups
- Nightly backups are included and retained for 30 days
- Optional hourly backups are available as a paid add-on
- While we maintain backups, you are ultimately responsible for your data
8. Customer Responsibilities
You are responsible for:
- Your website content
- Ensuring compliance with laws and regulations
- Maintaining copies of critical data
9. Intellectual Property
You retain ownership of your content.
You grant us a limited license to host, store, and process it as required to provide services.
10. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for any indirect, incidental, or consequential damages
- We are not liable for data loss, downtime, or security breaches
- Our total liability is limited to the amount paid by you in the last 3 months
11. Disclaimer
Services are provided “as is” and “as available” without warranties of any kind, including:
- Uptime guarantees beyond stated SLA
- Fitness for a particular purpose
- Security or error-free operation
12. Termination
You may cancel your service at any time.
We may terminate or suspend accounts:
- For AUP violations
- For non-payment
- At our discretion with reasonable cause
13. Governing Law
These Terms are governed by the laws of Ontario, Canada.
14. Changes to Terms
We may update these Terms at any time. Continued use of services constitutes acceptance of updated Terms.
